Do you really need an attorney to get an estate through probate? Not always, but in most cases it is recommended. Small estates, with an uncontested will, should go through the system by just filling out a few forms and filing them in the correct place. Attorney fees for small estate cases start as low as $250.00, a small price to pay to make sure all of the paperwork is filed correctly. The larger the estate, the more complicated the process becomes, and of course, the attorney fees go up as well. If the deceased died testate, with a current will, and the will is uncontested, probate court should move along fairly quickly.

Probate cases become expensive when a will is contested, or there are tax issues, or problems involving custody of minor children. Large estates with a poorly written, or non existent will, could get tied up in probate for over a year and end up costing thousands in attorney fees.

If you are the Personal Representative for an estate you may already have an attorney chosen for you. If the deceased worked with an attorney to write the will, and possibly other types of estate planning, this is the person you should probably have help get the estate through probate. If an attorney has not been chosen, one of your many duties as Personal Representative, should be to hire a Utah probate attorney to help with all your obligations, to the court and the other heirs.
