South Dakota Probate Attorney

Many states do not have a special probate court. They do, however, all have a probate process. In South Dakota this process is taken care of in a Circuit Court in one of the 7 Judicial Circuits. If you are in Rapid City, Sioux Falls, or anywhere in between, there should be a courthouse near you ready to hear your probate case. It may not be called a probate court but you should still be accompanied by a South Dakota probate attorney.

Need an Estate Lawyer?

Do you always need an attorney to represent you in probate court? No you don't, but with attorney fees starting as low as $250.00 there is little reason not to. But if you insist, visit Legal Zoom for the proper legal forms. Just be careful, and if in doubt, call an attorney.

If you are the Personal Representative for an estate your obligations and duties are are all very important. You are responsible to the other heirs and to the court. You also have some personal liability involved, should any errors arise. This is definitely a situation where you would want the help of an attorney.

Maybe you are contesting a will and wondering if you need a probate attorney. The size of the estate and the amount you are contesting should answer that question. The more that is at stake the more you need a South Dakota probate attorney.

Estate Planning

You may also be wondering is the probate process really necessary? There are many legal ways to avoid probate, but they all have to be done while the estate owner is alive. Probate avoidance is just part of estate planning, the kind of planning that can be done with a probate attorney that has an interest in you and your personal finances.

So how do you find an attorney that is willing to take a personal interest in you, your family and your finances? Just like you would find any other professional, you ask family and friends who they use. You may also find the services at Legal Match helpful. After interested attorneys respond to your request you are allowed to check them out by the feedback of others that have used them. It's a good system and will cost you nothing unless you actually hire a South Dakota probate attorney.

I just want to thank you for this site. It answered my questions. I think many people that do research on the net take it for granted and when they find what they are looking for they forget "someone put time, money, etc into providing me with this information."

Thank you!
